Data Star Terms and Conditions for Online Purchasing

The use of this site is governed by the policies, terms and conditions set forth on this page. Please Read Them Carefully. Your use of this site indicates your acceptance of these terms and conditions. These terms and conditions supercede any terms and conditions included with any purchase order. Data Star reserves the right to make changes to this site and these terms and conditions at any time.

Privacy and Security

At Data Star your privacy is important to us. We appreciate our customers and understand the value of protecting your rights. We keep your personal information private and secure. This information is to process your orders, and to personalize your shopping experience. We will not provide any information collected by our online site to any other party. Our secure servers protect the information using advanced encryption and firewall technology. Data Star uses Secure Socket Layer (SSL) Technology for mutual authentication, data encryption and data integrity to insure secure transactions for our customers. SSL is the Industry standard security protocol used to encode sensitive information.

Guarantee of Satisfaction

Items purchased from Data Star may be returned within 14 days from the date of purchase. The customer is responsible for all shipping and handling charges. Any returned items must be in "as new" condition. A restocking fee of 20% will apply. Refunds will be made at current market price for in-store credit. All items must be returned using the Data Star Return Merchandise Authorization (RMA) policy. All items returned must be accompanied by a copy of the original receipt and must be in the original packaging. No refunds or exchanges are allowed after 14 days. Shipping fees will not be refunded if shipment is refused at time of delivery and will be charged to the original credit card.

Order Acceptance

Your receipt of an electronic or other form of order confirmation does not constitute our acceptance of your order. Data Star reserves the right, without prior notification, to refuse to do business with any individual or entity.

Payment Methods

Data Star accepts Master Card, Visa, Discover and American Express cards. We do not add any surcharge to credit card purchases. To insure efficient processing please provide your exact billing address and telephone number as listed on file with your credit card bank. For your protection we will only ship to the cardholder billing address, or to a pre-authorized ship-to address as arranged with the credit card bank. Your credit card will be charged upon processing your order.

Data Star accepts Money Orders, Cashiers Checks, company checks, and personal checks in U.S dollars only. Orders are processed promptly on receipt of a Money Order. For Cashiers Checks, company checks, and personal checks please allow up to 10 banking days after receipt for clearance of funds before the order is processed. Data Star cannot guarantee the availability of product by the time funds clear. Checks returned as non-payable will incur a $25.00 charge.

Data Star accepts purchase orders from educational and government institutions, and companies when prior approval has been confirmed.

Applicable Taxes

Data Star will charge sales tax, where applicable, for orders delivered to Maryland addresses only. All other customers shall be solely responsible for all applicable taxes. Maryland Tax Exempt organizations must provide a copy of their Tax Exempt Form applicable to the respective order billing and ship-to address.


Order Cancellation

Order cancellation of an online order must be advised by email. This must be done as soon as possible. If an order is cancelled after it has been invoiced and/or shipped the customer will be responsible for a 20% re-stocking fee and all shipping costs. The balance of the invoice will be refunded within 7 days after the product is received, in new condition, at the Data Star facility.


Shipping Policy

Data Star makes every effort to ship within 24 hours of the receipt of an order, subject to stock availability, for all components, parts, software, consumables, etc. Data Star "Build-to-Order" systems are shipped within 5 to 7 days of receipt of order. Data Star does not ship on Saturday, Sunday, or major holidays. Please contact the Data Star Sales Office for "mission critical" or expedited needs.

Shipment Refusal

Refusal of a shipment without prior authorization from Data Star will incur a 20% restocking fee, charge for shipping costs, and an in-store credit for the balance of the order.


Damage in Shipment

The customer should refuse delivery of any shipment that has obvious damage. Contact the Data Star Sales Office and we will re-ship your order. The carrier is responsible for the damage. If you accept a shipment and discover damage, immediately contact the shipper to inspect the damage, then contact our Sales Office. We will also assist you if a shipment is lost in-transit.


Shipping Restrictions

Data Star accepts orders for delivery in the United States only. We are unable to make a shipment to a P.O. box. If the "Ship-To" address is different from the "Bill-To" address a $10.00 Address Verification will be incurred unless prior authorization has been approved.


Customer Pickup

Data Star welcomes online order pickup at our retail store, conveniently, located at 8185 Ritchie Highway, Pasadena, MD, 21122. Directions can be easily provided by visiting the Location page on this web site, both to and from our location. Please select "Customer Pickup" as the shipping option when placing the order, and phone us at least an hour prior to coming to our facility to confirm that the order will be ready. Availability and Pricing

Pricing and availability are subject to change without notice. Due to the unpredictable nature of the computer marketplace, descriptions may not reflect current technical information. Any error in typographical, photographical or specification in product, pricing or offers is subject to correction.


Backorders

Due to fluctuations in product availability and market demand, we may not have a particular item available for immediate shipment. In this event, we will contact you with regard to supply and delivery options.


Warranties

All new products are sold with the manufacturers' limited warranty. The warranty period and service varies by manufacturer and product. Please contact the respective manufacturer's for the full text of the available warranty. Data Star provides direct warranty processing of most products during the first 14 days after billing, however, some product warranties are direct with the manufacturer. Data Star "Build-to-Order" Personal Computer Systems have an initial 1 year Data Star Direct Depot warranty. If you have any questions with regard to a product warranty please contact the Data Star Sales Office.


Manufacturer Rebates

Rebate and coupon offers provided by manufacturers are subject to the terms and conditions specified by the manufacturer.


Return Policy

All returns require the issuance of an RMA# prior to return. Please contact Data Star to obtain the Return Material Authorization (RMA) number and details including mailing address and procedures. RMA#'s are valid for 14 days from the date of issuance. Data Star is unable to accept returns without an RMA#. For your convenience we have an easy to use form and procedure on our Web Site. (see RMA Procedure)


RMA Procedure

Any product returned to Data Star must have an authorized RMA# displayed on the outside of the shipping container. An RMA# can be obtained by submitting a completed RMA# Request Form (see Contact Us). Returns must be packaged in a shipping container that will protect the item. Items not properly packaged will be refused/returned to the shipper and will void all warranties with Data Star. Returns must be sent via a courier that provides shipment tracking. Any product returned as defective, but, found non-defective will incur a $25.00 diagnoistic fee and return shipping charge. Any item returned to Data Star not in good condition with damaged packaging and/or missing parts, manuals, registration forms, etc can not be returned for re-stock or replacement and will be returned to the customer with the customer responsible for return shipping charges.

Disclaimer of Warranty, Title to Goods

DATA STAR HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. This disclaimer in no way affects the term of any manufacturer's warranty. The title to purchased goods is retained by Data Star until all goods are paid for by the purchaser.


Limitation of Liability

IN NO EVENT SHALL DATA STAR, ITS SUBSIDIARIES, OR AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, OR AGENTS BE LIABLE FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES (INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, USE, OR PROFITS), HOWEVER CAUSED, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE, OR OTHERWISE, AND WHETHER OR NOT DATA STAR HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. YOU AGREE THAT THE DATA STAR MAXIMUM LIABILITY ARISING FROM ANY PRODUCT SOLD BY DATA STAR SHALL NOT EXCEED THE PRICE OF SUCH PRODUCT.
